The Disputes Tribunal has ordered Kmart to pay a Christchurch couple thousands of dollars after their toddlers played in asbestos-contaminated sand.
A Christchurch couple whose toddlers played in asbestos-contaminated sand purchased from Kmart asked the retail giant to cover testing and related costs. The Disputes Tribunal found the play sand was unsafe, not fit for purpose, and not of acceptable quality under the Consumer Guarantees Act. Kmart has been ordered to pay $15,185 to cover the bills.
