Gloriavale Christian School challenges closure in High Court
The Gloriavale Christian School's governing board argues its closure would be unlawful, as the High Court hears the case on Monday.
What happened
Gloriavale Christian School's governing board has filed documents asserting that the Education Ministry's decision to cancel the school's registration and close it would be unlawful and an overuse of state power against a religious and cultural minority. The 80-student school on the West Coast remains open pending the High Court challenge. The Ministry's Secretary for Education Ellen Macgregor-Reid cancelled registration after the school failed a second Education Review Office audit in as many years, citing concerns that it is not a physically and emotionally safe place for students. The board argues the Ministry has not considered the effects on Gloriavale children or the practical burden of the nearest primary school being 40 minutes away and high school one hour away. The board contends the school has made significant improvements, denies instances of sexualised misbehaviour, and says child protection systems are in place. The ERO's July review found inconsistencies between school and community child protection policies and noted two allegations of staff misconduct under investigation by the teaching council, with one staff member suspended. The board argues closing the school would breach parents' rights to educate children according to their religion and values, and that boarding schools would unacceptably separate children from their families and community.
Why it matters
The Ministry cancelled the school's registration in September 2026 after earlier ERO reviews found failings. In late September 2026, the Charities Registration Board also deregistered Gloriavale's trust over serious wrongdoing including child labour and governance failures, and in late September a teacher was censured for striking a student with a vacuum pipe in 2013. The school board's challenge now tests whether the closure decision can withstand judicial review.
